Il Superbonus 110% consente di trasformare la detrazione fiscale spettante per gli interventi edilizi in un credito d’imposta cedibile – anziché utilizzarlo in dichiarazione IRPEF – tramite le modalità della “cessione del credito” o dello “sconto in fattura”.
Questo meccanismo permette di monetizzare immediatamente il beneficio fiscale, evitando di dover attendere i tempi lunghi della detrazione in dichiarazione e contribuendo a migliorare la liquidità di famiglie e imprese coinvolte nei lavori.
L’introduzione di tale sistema ha dato origine a un vero e proprio mercato dei crediti fiscali: i crediti maturati possono essere trasferiti a soggetti terzi, quali imprese, istituti di credito o altri intermediari finanziari, che assumono il ruolo di “sostituti d’imposta” e utilizzano tali crediti in compensazione delle proprie imposte.
In funzione delle condizioni di mercato, i crediti vengono generalmente ceduti a un prezzo inferiore rispetto al loro valore nominale (ad esempio, un credito di 100 può essere acquistato a 90 o 95), generando un vantaggio economico sia per il cedente – che ottiene liquidità immediata – sia per l’acquirente, che beneficia di un risparmio fiscale rispetto all’esborso sostenuto.
Per agevolare queste operazioni è stata predisposta una piattaforma telematica, gestita dall’Agenzia delle Entrate, che consente di comunicare la cessione, accettare o rifiutare il credito e monitorarne lo stato: fino all’accettazione da parte del cessionario, il credito non è utilizzabile né dal cedente né da altri soggetti.
La corretta gestione delle comunicazioni, delle accettazioni e delle eventuali successive cessioni è cruciale per evitare blocchi operativi, contestazioni o la perdita del diritto alla compensazione. Per tale motivo, imprese e professionisti si rivolgono frequentemente a consulenti specializzati in ambito fiscale e finanziario, in grado di presidiare tutti gli adempimenti richiesti dalla normativa vigente.
In questo contesto, i crediti fiscali assumono le caratteristiche di una vera e propria “moneta fiscale”, che può essere oggetto di acquisto e vendita, offrendo da un lato liquidità ai beneficiari originari dei lavori e, dall’altro, una forma di investimento per i soggetti che acquistano il credito, purché siano rigorosamente rispettate le regole di compensazione e di utilizzo previste dall’ordinamento.
Per le imprese, in particolare, l’accesso a questo mercato può rappresentare uno strumento strategico di gestione della liquidità e di ottimizzazione dell’onere fiscale complessivo; tuttavia, richiede un’attenta valutazione dei rischi normativi, della capienza fiscale disponibile e delle condizioni economiche applicate alle operazioni di cessione o acquisto dei crediti.
