Addio al blocco generalizzato: la vittoria di imprese e professionisti
Il tanto discusso Articolo 26 della Legge di Bilancio 2026 mirava a introdurre, dal 1° luglio 2026, un divieto quasi totale di utilizzare i crediti d’imposta agevolativi per pagare i contributi INPS e i premi INAIL.
Tuttavia, dopo le forti proteste delle associazioni di categoria e degli ordini professionali, il Governo ha fatto marcia indietro. Il Viceministro dell’Economia Maurizio Leo ha confermato l’orientamento a eliminare la norma o a limitarla drasticamente.
Cosa sarebbe cambiato (e cosa resta salvo)
Se il blocco fosse passato, dal luglio 2026 non avresti più potuto usare in F24 crediti come:
- Transizione 4.0 e 5.0 (Investimenti in beni strumentali).
- Ricerca e Sviluppo.
- Crediti ZES.
- Bonus Edilizi (acquisiti tramite sconto o cessione).
Grazie a questo dietrofront, il meccanismo di compensazione tra bonus fiscali e debiti contributivi resterà sostanzialmente quello attuale.
Le regole oggi in vigore: facciamo chiarezza
Mentre il blocco generalizzato sembra scongiurato, è fondamentale ricordare che esistono già dei limiti precisi che restano validi:
- Canali Telematici: Ogni F24 che include compensazioni deve obbligatoriamente passare per i canali dell’Agenzia delle Entrate (Entratel o Fisconline).
- Settore Finanziario: Per banche, assicurazioni e intermediari finanziari, il divieto di compensare contributi INPS/INAIL con crediti da bonus edilizi (Superbonus e altri) scatterà comunque dal 1° gennaio 2025.
- Soglia di Debito: Attualmente, chi ha debiti erariali iscritti a ruolo superiori a 100.000 euro non può procedere a compensazioni fino alla regolarizzazione della posizione.
Casi pratici: l’impatto sulla tua liquidità
Perché questa notizia è così importante? Vediamo due scenari:
- PMI con Credito 4.0: Un’azienda con 100.000 euro di credito annuo per macchinari potrà continuare a usarlo per pagare i contributi dei dipendenti, evitando un pesante esborso di cassa mensile.
- Studi Professionali: Chi ha acquistato crediti edilizi potrà continuare a usarli per abbattere i costi contributivi INPS propri e dei dipendenti.
