Saldo e Stralcio: La Guida per Chiudere i Debiti e Ripartire

Ti sei mai chiesto se esiste un modo per chiudere un debito pagando meno di quanto dovuto? La risposta è sì, e si chiama Saldo e Stralcio. Si tratta di un accordo transattivo tra creditore e debitore che permette di estinguere una posizione debitoria versando una cifra forfettaria, solitamente molto inferiore al debito originario.

Come funziona il Saldo e Stralcio?

In un’operazione di saldo e stralcio, il debitore propone al creditore (spesso una banca o una società di recupero crediti) il pagamento immediato di una somma fissa a fronte della cancellazione totale del debito residuo.

Perché il creditore dovrebbe accettare?

Certezza dell’incasso: La banca riceve subito liquidità, evitando i tempi lunghi e i costi delle procedure legali o dei pignoramenti.
Riduzione degli NPL: Come abbiamo visto, le banche hanno interesse a “pulire” i propri bilanci dai crediti non performanti (NPL).
Risparmio gestionale: Si eliminano i costi di gestione di una pratica incagliata da anni.

La novità: Pace Fiscale 2026

La nuova Legge di Bilancio 2026 introduce una forma di “saldo e stralcio” normato dallo Stato, noto come Pace Fiscale. Questa misura riguarda i carichi affidati all’agente della riscossione fino al 31 dicembre 2023.

Ecco le caratteristiche principali della Pace Fiscale 2026:

Chi può aderire: Contribuenti che hanno presentato la dichiarazione ma hanno omesso il pagamento.
Modalità di pagamento: È possibile scegliere tra un’unica soluzione o un piano di rientro in 9 anni suddiviso in 54 rate bimestrali di uguale importo.
Estensione: La misura è aperta anche agli enti locali che decidono di aderire.

I vantaggi per il debitore

Sconto sul debito: Spesso si riesce a stralciare una quota che va dal 40% al 70% del debito totale (inclusi interessi e sanzioni).
Cancellazione delle segnalazioni: Una volta onorato l’accordo, il debito è estinto e si può avviare la procedura per essere cancellati dalle banche dati dei cattivi pagatori (CRIF).
Fine delle azioni esecutive: Si bloccano eventuali pignoramenti dello stipendio o della pensione.

Attenzione: Gli effetti sulla solvibilità

Bisogna ricordare che, a differenza della Cessione del Quinto (che è un debito regolarmente rimborsato tramite busta paga), il saldo e stralcio nasce da una situazione di difficoltà. Anche se il debito viene chiuso, la segnalazione di “accordo transattivo” può rimanere visibile nei sistemi di informazioni creditizie per un periodo determinato, influenzando la capacità di ottenere nuovo credito nell’immediato.
