Un istituto normativo che consente, soprattutto a privati e piccole imprese in situazione di sovraindebitamento, di presentare un piano al giudice per la ristrutturazione o la liquidazione dei debiti, evitando – ove possibile – procedure esecutive frammentate e più onerose. Il piano viene predisposto con la mediazione e l’assistenza di organismi di composizione della crisi (OCC) autorizzati, che analizzano la posizione debitoria complessiva, verificano la sostenibilità delle proposte di pagamento e supportano il debitore nella predisposizione della documentazione necessaria. Una volta depositato, il piano deve essere approvato dal tribunale, che ne valuta la fattibilità giuridica ed economica e, se ricorrono i presupposti, lo omologa rendendolo vincolante anche nei confronti dei creditori.
Dal 2025 sono previste maggiori tutele e una maggiore flessibilità per l’esdebitazione, ossia per il meccanismo che permette di cancellare parzialmente o totalmente i debiti residui una volta rispettato il piano omologato. In questo modo, il debitore onesto ma in difficoltà può ottenere una vera “ripartenza”, con il ripristino di condizioni di sostenibilità finanziaria, il recupero della propria capacità di programmare il futuro e una tutela più efficace della propria dignità personale e professionale.
